Section 39
Disposition versions
39. The court shall dispose of such motion after taking into account the following facts:
(a) the value of the goods at the time of the default;
(b) the amount already paid by the consumer;
(c) the balance due to the merchant;
(d) the solvency of the consumer;
(e) the reason for the default of the consumer.
