3. With the exception of the officers of justice enumerated in section 4, every person acting as clerk of the justices of the peace, either ex officio or by virtue of appointment as such in conformity with the provisions of section 195 of the Courts of Justice Act (chapter T-16) who receives from an offender, gaoler, constable or other person a fine imposed under the Criminal Code (Revised Statutes of Canada, 1985, chapter C-46), a federal or provincial penal law, or a municipal by-law, shall transmit the same without delay to the Minister of Justice, by cheque or money-order payable to the order of the Minister of Finance who is authorized to pay it to those indicated by law as being entitled thereto.
