49. Every person who contravenes section 9 is liable, on an application by the prosecutor which is attached to the statement of offence, in addition to the penalties provided in section 44 or 45,
(a)  for a first offence, to an additional fine of not less than $1 400 nor more than $2 800 for each day or part of a day during which the offence continues;
(b)  for a subsequent conviction, to an additional fine of not less than $2 800 nor more than $5 775 for each day or part of a day during which the offence continues.
