The justice of the peace shall not refuse to state a case unless the application appears to him to be based on frivolous grounds, and he shall in such case, on the request of the applicant, sign and deliver to him a certificate attesting such refusal; provided that the justice shall never refuse to state a case where the application is made to him by or under the direction of the Attorney General.
