Section 114 Disposition versions

114. Every person who contravenes any provision of this Act, a joint plan, a by-law, an agreement made between a producers’ board and persons engaged in the marketing of the marketed product, an order of the Board or arbitration decision is guilty of an offence and is liable, in addition to payment of the costs,

(a)  for a first offence, to a fine of not less than $350 nor more than $1 750 in the case of a natural person, and not less than $700 nor more than $3 500 in the case of a corporation;

(b)  for a subsequent offence within two years, to a fine of not less than $575 nor more than $5 750 in the case of a natural person, and not less than $1 150 nor more than $11 500 in the case of a corporation.

(a)  for a first offence, to a fine of not less than $300 nor more than $1 500 in the case of a natural person, and not less than $600 nor more than $3 000 in the case of a corporation;

(b)  for a subsequent offence within two years, to a fine of not less than $500 nor more than $5 000 in the case of a natural person, and not less than $1 000 nor more than $10 000 in the case of a corporation.

Every person who contravenes any provision of this act, a joint plan, a by-law, an agreement made between a producers’ board and persons engaged in the marketing of the marketed product, an order of the Board or arbitration decision is guilty of an offence and is liable, in addition to payment of the costs,

(a)  for a first offence, to a fine of not less than $100 and not more than $500 in the case of a physical person, and not less than $200 and not more than $1,000 in the case of a corporation;

(b)  for a subsequent offence within two years, to a fine of not less than $200 and not more than $3,000 in the case of a physical person, and not less than $500 and not more than $5,000 in the case of a corporation.
