12.5. Before instituting penal proceedings, the prosecuting party shall serve a notice of offence on the offender by mail. The notice constitutes an information.

12.5. Penal proceedings brought under this Act are instituted in accordance with the Summary Convictions Act (chapter P-15).
Notwithstanding the foregoing, the prosecuting party shall serve a notice of offence on the offender by mail. The notice constitutes an information.
