85. (1) The director general of elections must forward to the Prime Minister, to the Leader of the Official Opposition and to every member who, other than the Leader of the Official Opposition, is the leader in the Assemblée nationale of an opposition party mentioned in section 77 of the Legislature Act, on or before the third day following the first day of the annual enumeration or, as the case may be, on the third day following that of the issue of a writ, a complete list of the places where boards of revisors are to be established, indicating the electoral district where each board is to sit. The Prime Minister or the person appointed in writing by him for each electoral district and the Leader of the Official Opposition or the person appointed in writing by him for each electoral district may each, on the eight day following the first day of the annual enumeration, or, as the case may be, on the eight day following that of the issue of a writ, recommend in writing to the returning-officer a person to act as a member of each board of revisors.However, in each electoral district represented by a member of the opposition who is not a member of the Official Opposition or who sits as an independent member, having been elected as such, every written recommendation of a person to act as a member of each board of revisors contemplated in the first paragraph shall be made in that district by him or the delegate he designates in writing to the returning-officer, in the place and stead of the Leader of the Official Opposition or his delegate.
Furthermore, in the electoral districts of Abitibi-Est, Abitibi-Ouest, Duplessis and Saguenay, more than one delegate may be designated in writing to the returning-officer provided that the territory assigned to each of them is clearly defined.
Where an election is ordered requiring the holding of a second revision, or at general elections contemplated in the third paragraph of section 454 of this act, the written recommendation respecting the appointing of revisors must be made to the returning-officer by the persons mentioned in the first paragraph on or before the eighth day following that of the issue of the writs of election. However, every candidate who was a member of an opposition party other than the Official Opposition or who, having been elected as such, was sitting as an independent member at the dissolution of the Assemblée nationale, or any delegate he designates in writing to the returning-officer, may recommend, in writing to the latter, a person to act as a member of each board of revisors in the electoral district where he is a candidate, in the place and stead of the Leader of the Official Opposition or his delegate.
The returning-officer shall then appoint as members of each board of revisors the two persons so recommended; if he has received no written recommendation, he shall choose the two revisors himself; if he has received only one recommendation, he shall choose the other revisor himself. As soon as such appointments are made, the returning-officer shall so inform the director general of elections in writing.
At a by-election during which an enumeration and revision must be made, the written recommendations respecting the appointing of the revisors must be made to the returning-officer by the persons mentioned in the first two paragraphs, on or before the seventh day following that of the issue of the writ of election and, within the same delay, subject to the provisions of the fourth paragraph, the returning-officer shall make such appointments.
