79.1. For the purposes of this division,

“brewer” means:

(a)  the Société des alcools du Québec;

(b)  every person being the holder of a brewer’s permit issued under the Act respecting the Société des alcools du Québec (chapter S-13);

(c)  every person operating an interprovincial or international passenger transport undertaking

i.  on land; or

ii.  on water and operating as a carrier between various ports of Québec;

“distributor” means:

(a)  every person who distributes soft drinks in non-returnable containers, in and outside Québec, except persons selling exclusively as retailers in Québec and having no place of business outside Québec;

(b)  every person who packs soft drinks in non-returnable containers in Québec or who brings into Québec or has a supplier from outside Québec deliver to him in Québec soft drinks in such containers,

(c)  every person operating an interprovincial or international passenger transport undertaking

i.  on land; or

ii.  on water and operating as a carrier between various ports of Québec;

“soft drink” means aerated water to which an essence or syrup is added.
