367. The secretary-treasurer of such municipal council shall enter, in a book or register specially and exclusively intended for such purpose, the school taxes so collected, which taxes shall not be employed by a municipal corporation for any purpose whatsoever.
The secretary-treasurer of the said municipal council is, in addition, bound, as the school taxes are collected, to deposit the same in the name and to the credit of the said board, in a lawfully incorporated bank in the locality, or, if there be no such bank therein, in the nearest locality thereto.
Notwithstanding any provision to the contrary, any person who directly or indirectly infringes or attempts to infringe or abets or procures any person to infringe the provisions of this section shall be guilty of an offence and shall be liable, in addition to the costs, to a fine not exceeding $200, and, in default of payment of such fine and costs, to an imprisonment not exceeding six months.
