211. Every person holding a pedagogical or educational position who does not intend to continue his engagement for the following year must give the school commissioners or trustees, as the case may be, notice in writing of his intention at least sixty days before the date of the expiration of his engagement.
When any such person has not given such notice in due time and does not carry out his engagement, he shall be liable, for each day of delay in giving such notice, to a fine equal to one five-hundredths of his last yearly salary, recoverable by the school board in accordance with sections 458 and 460.
The preceding paragraph shall apply to any such person who has bound himself explicitly as well as to one who is tacitly bound for lack of notice.
Section 459 shall not apply to such prosecution, which shall not be taken except by the commissioners or trustees.
The conviction shall free the person convicted from any recourse in damages resulting from the same facts.
