638. For the purposes of this chapter, a party acts or omits to act if its leader, another of its executive officers, its official representative or his delegate or its official agent or his deputy performs, allows or tolerates the act or omission.
Where the party commits an offence as described in the first paragraph, every person mentioned in that paragraph who has performed, allowed or tolerated the act or omission may be prosecuted and convicted with the party or instead of the party.
The first and second paragraphs apply, adapted as required, with respect to the act or omission of a ticket.
