107. The Commission may, at the request of an employee or on its own initiative, apply to the Commission des relations du travail for any appropriate measure against any person who takes reprisals against an employee because(1) the employee is exercising any right conferred on him by this Act;
(2) the employee has provided information to the Commission pursuant to this Act; or
(3) the employee is a witness in a proceeding under this Act.
The employee’s request under the first paragraph must be made to the Commission within 30 days of the reprisals.
The Commission may, in particular, request the Commission des relations du travail to order that the injured employee be reinstated, on such date as the Commission des relations du travail considers fair and expedient in the circumstances, in the position he would have held had it not been for the reprisals.
Before the Commission may so apply to the Commission des relations du travail for measures for an employee’s benefit, it must obtain the employee’s written consent.
