10. The permit holder contemplated in subparagraphs 2.1, 3, 4 and 5 of the first paragraph of section 4 and in subparagraphs 2.1, 3 and 4 of the first paragraph of section 5 shall form a committee of parents composed of five persons who are not members of the staff of the day care centre or nursery school, elected by and from among the parents of children received by the day care centre or nursery school.
The parent of a child received by the day care centre or nursery school who is either the permit holder contemplated in subparagraph 5 of the first paragraph of section 4 or in subparagraph 4 of the first paragraph of section 5 or, where the permit holder is a corporation, a member of the board of directors cannot be a member of the committee.
The permit holder shall consult the committee on all aspects of the life of the children received by the day care centre or nursery school and, in particular, on(1) the preparation, evaluation and revision of the programme of activities to promote the physical, intellectual, emotional, social and moral development of the children;
(2) the acquisition and use of the educational materials and equipment to be used in the day care centre or nursery school;
(3) the location or the change of location of the day care centre or nursery school;
(4) the arrangement and furnishings of the day care centre or nursery school;
(5) the services to be provided in the day care centre or nursery school.
The holder contemplated in section 7 shall form a committee of parents composed of five persons who are not members of the staff of the home day care agency, elected by and from among the parents of children who are be received by the persons he has recognized as persons responsible for home day care. The permit holder shall consult the committee on all aspects of the life of the children received by these persons. However, the permit holder is not required to form such a committee where its board of directors is composed in the majority of parents who are not members of the staff of the home day care agency where the children are received by the persons the permit holder has recognized as persons responsible for home day care.
