93. Where damages as well as a penalty may be given, such damages and penalty may be sued for separately, and such penalties and damages may be levied by seizure from the goods of the defendant, and in case the defendant has no goods to satisfy the same, he shall be committed to the house of detention for such term of not more than two months as the justice or court directs.
