437.5. The council of a local municipality may apply to the Court of Québec, in accordance with the rules of ordinary procedure prescribed by the Code of Civil Procedure (chapter C‐25), for the cancellation of the permit, certificate or any other authorization granted by the municipality for an activity or use in an immovable or part of an immovable accessible to the public(1) where the activity or use may endanger the life or health of persons or cause serious or irreparable damage to property;
(2) where the activity or use disturbs public tranquility.
Any such motion shall be heard and decided by preference.
Such a proceeding, however, may not be brought in cases where an application may be made by the municipality to the Régie des alcools, des courses et des jeux under section 85 of the Act respecting liquor permits (chapter P‐9.1).
