387. When a poll is held by ballot, there must be a re-addition of the votes if it be made to appear, on the affidavit of a credible person, that the presiding officer has improperly added up the votes; and there must be a recount if it be made to appear by such affidavit that the presiding officer or deputy presiding officer, if any, has illegally counted or rejected any ballot paper, or has made an incorrect statement of the number of votes cast for any candidate.
A recount must also be made when the presiding officer has declared, in accordance with article 338, that there is a tie. In such a case, articles 389, 390 and 401 to 403 do not apply.
