In all cases where, because of incapacity, absence, holiday, sickness, death, resignation, retirement or appointment to another post, the judges of the Court of Appeal are insufficient in number to ensure the prompt dispatch of business, the chief justice or, in his absence, the senior puisne judge may ask in writing the Chief Justice of the Superior Court to designate a judge of that court to sit in the Court of Appeal as a judge ad hoc.
