If the arbitrators delay in hearing the case or do not file their award within the time fixed, the court may either dismiss them and order that the case proceed in the ordinary way, but taking into account any evidence already heard, or make such other order as it considers appropriate; in either case the court adjudicates as to costs according to the circumstances.
