174. A defendant who has presented a motion under article 161 must file his defence within the delay in which he could have urged other preliminary exceptions under article 162.
A defendant who has presented a motion under article 162 must file his defence within five days, from the judgment dismissing the motion, or from the judgment maintaining for costs only an exception to dismiss the action, or from the expiry of the delay granted by law or by a judgment maintaining a dilatory exception, or from a judgment ordering the striking of an allegation under article 169.
