On the application of a defendant who has served an application for leave to appeal from the judgment under which he is imprisoned, a judge of the Court of Appeal shall release him from custody on the conditions he determines, particularly the furnishing of security, unless he is satisfied that the defendant will abscond or will not keep the peace while awaiting judgment on the appeal; the judge ordering continuation of the detention of the defendant shall make any order that may expedite the hearing in appeal.
Prior notice of at least one clear day of the application for release from custody must be served on the prosecutor.
