89. The Minister of Municipal Affairs may, after consultation with the Minister of Cultural Affairs, by regulation:(a) establish rules concerning the preservation and destruction of the documents in the custody of the clerk, the treasurer or, as the case may be, the director of finance;
(b) determine which of such documents may, on resolution of the council, be withdrawn from the custody of the clerk, the treasurer or, as the case may be, the director of finance and otherwise preserved, disposed of or destroyed, notwithstanding any contrary provision of law but subject, however, to the Cultural Property Act (chapter B-4);
(c) impose rules and conditions for the carrying out of subparagraph b.
The regulation adopted under this section comes into force on the day of its publication in the Gazette officielle du Québec or on any later date fixed therein.
This section applies to every city or town municipality, even to those not contemplated by section 1. However, it does not have the effect of preventing the carrying out of an order passed or that may be passed under section 6 of the Photographic Proof of Documents Act (chapter P-22) referring to a municipality to which this section is applicable.
