97.1. An authorized insurer may also issue a certificate of insurance to a person who is not resident in Québec provided that the policy issued by him outside Québec meets the requirements of Division II.
An unauthorized insurer may be authorized by the Agence nationale d’encadrement du secteur financier to issue such a certificate to such a person if he authorizes the Agence nationale d’encadrement du secteur financier to receive service of any proceeding instituted against him by reason of an accident that occurred in Québec.
In both cases, the insurer must, furthermore, undertake, in a written document remitted to the Agence nationale d’encadrement du secteur financier, to satisfy any judgment as if the insurance policy and the certificate had been issued in Québec.
The Agence nationale d’encadrement du secteur financier shall revoke the authorization of every insurer who fails to carry out his undertakings; from then on, the certificates issued by that insurer are void.
