48. (1) The land surveyor, and those who assist him, may, in the performance of their duties, pass over any property and thereon perform the operations they consider necessary.
(2) If the land surveyor, or his assistants, cause any damage in performing their duties, the party aggrieved shall have recourse against the land surveyor.
(3) The land surveyor shall have a right of recovery against the party for whom he has performed his duties, unless the damages result from his fault.
