44. The costs of the provisional administration and the fees of the provisional administrator are charged to the seller and become payable upon being approved by the president.
If the provisional administrator is unable to deduct the total amount of the costs and fees from the seller’s own funds, of which he may have taken possession pursuant to section 43, the balance of the amount may be taken out of the funds held in trust and the balance shall then affect proportionally the claim of each buyer. In such a case, each buyer is subrogated to the rights of the provisional administrator against the seller for an amount equal to the amount of his claim affected to the payment.
