40. Where the rightful owner or possessor of property seized by an inspector is unknown or untraceable, the property or the proceeds of its sale shall be transferred 90 days after the day of seizure to the Minister of Revenue or to the Minister of Finance, according to whether it is the property or the proceeds of sale that is involved; a statement describing the property or the proceeds of sale and indicating, where applicable, the name and last known address of the interested party shall be sent to the Minister of Revenue at the time of the transfer.
The provisions of the Public Curator Act (chapter C‐81) pertaining to unclaimed property apply to the property or proceeds of sale so transferred to the Minister of Revenue or to the Minister of Finance.
