103. The holder of a timber supply guarantee may not claim an indemnity or compensation from the Government if, in the course of a year, part of the annual volumes of timber specified in the guarantee could not be sold to the holder owing to a natural disturbance or human interference or to a decision of the Minister restricting or prohibiting in the public interest access to or travel in the forest.
In the latter case, however, the volumes of timber must be offered to the holder entitled to it as soon as they become available, if the holder continues to operate the plant benefiting from the guarantee. If there is more than one guarantee holder entitled to them, the volumes of timber are divided among the guarantee holders in proportion to the volumes that could not be sold to them.
