38. Anyone who operates or purports to operate a tourist accommodation establishment for which the issue of a classification certificate has been refused or whose classification certificate has been suspended or cancelled is guilty of an offence and is liable to a fine of $5,000 to $50,000 in the case of a natural person and $10,000 to $100,000 in other cases.

38. Every person who operates or purports to operate a tourist accommodation establishment without holding a classification certificate issued under this Act is guilty of an offence.
Every person who is guilty of an offence under the first paragraph or under section 32 is liable, for each day or part of a day during which the offence continues, to a fine of $750 to $2,250, and, in the case of a second or subsequent conviction, to a fine of $2,250 to $6,750.

Every person who contravenes a provision of the first paragraph or of section 32 is guilty of an offence and is liable, for each day or part of a day during which the offence continues, to a fine of $750 to $2,250, and, in the case of a second or subsequent conviction, to a fine of $2,250 to $6,750.

38. Every person who contravenes a provision of section 4 or 32 is guilty of an offence and liable, for each day or part of day during which the offence continues, to a fine of $625 to $2 450 and, in the case of a second or subsequent conviction, to a fine of $2 450 to $4 875.
