96. For each accident and disease contemplated in section 95, the Commission determines the compensation cost in accordance with the rules provided for in this Subdivision. The cost corresponds to the amount required to pay all benefits resulting from the accident or disease with the exception of the portion imputed, pursuant to the second paragraph of section 326 or section 327, 328 or 329 of the Act, to another employer, to the employers of one, several, or all the units, or to the reserve provided for in paragraph 2 of section 312 of the Act.
Where the victim of an accident or of an occupational disease is an employer or an executive officer registered with the Commission under section 18 of the Act, the cost of the compensation corresponds to the amount required to pay all the benefits resulting from the accident or disease.
The Commission then applies, in accordance with this Subdivision, the factors used to determine the total cost of such accidents or diseases.
