16. If the total estimated quantity of soils to be transported is greater than 200 metric tonnes, the signatory of the tracking slip under section 14 must also provide the Minister, within 15 days after the last transportation of soils, with an attestation from a qualified person stating that all the soils transported outside the site of origin have been recorded on a tracking slip.
A person is qualified to provide the attestation referred to in the first paragraph if the person is(1) a professional within the meaning of section 1 of the Professional Code (chapter C-26) or a person authorized by a professional order to carry out an activity reserved to the members of that order; (2) the holder of a post-secondary diploma in a scientific discipline with not less than 5 years experience in site characterization and site rehabilitation and is neither the signatory of the tracking slip, the natural person who completed the tracking slip, the soil excavator, or one of their employees;
(3) a person certified in site characterization and site rehabilitation by a certification body accredited by the Standards Council of Canada under ISO Standard 17024.
