96. The operator of fuel burning equipment referred to in sections 88 and 89 or subparagraph 2 or 4 of the first paragraph of section 90 or of an industrial furnace referred to in the first paragraph or subparagraph 2 or 6 of the second paragraph of section 92 or paragraph 1 of section 94 must perform source emissions testing of the gases emitted into the atmosphere by the equipment or furnace, calculate the rate or concentration of the contaminants listed in the applicable provisions, and for that purpose, measure each of the parameters necessary for the calculation(1) at least once every 3 years in the case of the use of biogas or granules produced from lignocellulosic crops and in the case where the fuel used consists of used oil meeting the standards in Schedule 6 to the Regulation respecting hazardous materials (chapter Q-2, r. 32); and
(2) at least once a year for equipment or a furnace supplied with fuel other than fuel referred to in subparagraph 1.
The operator must carry out the first sampling and calculation within 1 year as of 30 June 2011 in the case of existing equipment or a furnace, or within 1 year as of the date on which the equipment or furnace is put into operation.
This section does not apply to an operator who uses biogas in fuel burning equipment with a rated heat capacity or rated power less than 3 MW.
