98. The per-container amount set pursuant to the first paragraph of section 95 may be allocated only to that container and, if it is partly or entirely included in the sale price for the product, must be internalized in the sale price as soon as the product is commercialized, marketed or otherwise distributed.
The internalized cost may only be made visible on the initiative of the producer who commercializes, markets or otherwise distributes the product, and in such a case the information must be made visible by the producer as soon as the product is commercialized, marketed or otherwise distributed. The information must include a mention that the amount is used to ensure the recovery and reclamation of the redeemable container and the internet address where more information may be obtained.
If a producer makes an internalized cost visible, any person who offers for sale, sells, distributes to a user or final consumer or otherwise makes available the product referred to in the first paragraph of section 95 may also, without being required to do so, make the amount visible. The person must, in such a case, include a mention for the same purpose as in the second paragraph and the same internet address.
