133. An animal may be killed by means of a hunting implement referred to in section 31 of the Regulation respecting hunting (chapter C-61.1, r. 12) following stalking, pursuit or stakeout if the following conditions are met:(1) the animal is kept in captivity by the holder of a professional licence to keep animals in a game ranch or a breeding farm issued under the Regulation respecting licences to keep animals in captivity (chapter C-61.1, r. 20.1.1); (2) the enclosure where the animal will be killed meets the following conditions:(a) a minimum area of 0.1 km2;
(b) a maximum area of 2 km2;
(c) a minimum width of 100 m;
(d) wooded over at least 80% of its area;
(e) entirely located on land on which the holder of a licence referred to in subparagraph 1 has a right of occupancy.
In the case of a white-tailed deer (Odocoileus virginianus), the tag must be attached to the animal until it is skinned and the owner must give to the person who kills it proof that the animal was sold or given to the owner. That proof must be kept by the person who transports the animal.
