Radiology Technologists Act
The Minister of Justice is entrusted with the application of this Act. Order in Council 1154-2008 dated 18 December 2008, (2009) 141 G.O. 2 (French), 40.

DIVISION I
DEFINITIONS
1. In this Act and the regulations made thereunder, unless the context indicates a different meaning, the following terms mean:
(a)  Order : the Ordre des technologues en radiologie du Québec constituted by this Act;
(b)  Bureau : the Bureau of the Order;
(c)  radiology technologist or member of the Order : any person entered on the roll;
(d)  (paragraph repealed);
(e)  roll : the list of the members in good standing of the Order prepared in accordance with the Professional Code (chapter C-26) and this Act.

DIVISION II
THE ORDRE DES TECHNOLOGUES EN RADIOLOGIE DU QUÉBEC

2. All persons qualified to practise the profession of radiology technologist in Québec constitute a professional order called the “Ordre professionnel des technologues en radiologie du Québec” or the “Ordre des technologues en radiologie du Québec”.

3. Subject to this Act, the Order and its members shall be governed by the Professional Code (chapter C-26).

4. The head office of the Order shall be at Montréal or at any other place in Québec determined by regulation of the Bureau adopted pursuant to paragraph f of section 93 of the Professional Code (chapter C-26).

THE BUREAU
5. The Order shall be governed by a Bureau established in accordance with the Professional Code (chapter C-26).

DIVISION IV
PRACTICE OF THE PROFESSION
7. Every act the object of which is to carry out technical work involving the use of X-rays or radio-elements on an animate being for therapeutic or diagnostic purposes constitutes the practice of the profession of radiology technologist.

8. No radiology technologist may perform any act described in section 7 for therapeutic purposes unless he does so according to a written prescription and under the supervision of a physician.
He may not perform any act described in section 7 for diagnostic purposes unless he does so according to a written prescription and under the supervision of a physician, a veterinary surgeon, a dentist or a person holding a permit contemplated by section 186 of the Professional Code (chapter C-26).

11. No person may practise the profession of radiology technologist under a name other than his own.
Radiology technologists may however practise their profession under the name of one or two or more of the partners.

DIVISION V
ILLEGAL PRACTICE OF THE PROFESSION
12. Subject to the rights and privileges expressly granted by law to other professionals, no person may perform any act described in section 7 except a radiology technologist.
The first paragraph does not apply to acts performed by a person in accordance with the provisions of a regulation adopted pursuant to paragraph h of section 94 of the Professional Code (chapter C-26).

13. Every person who contravenes section 12 is liable for each offence to the penalties provided in section 188 of the Professional Code (chapter C-26).

This Division ceased to have effect on 17 April 1987.

REPEAL SCHEDULE

In accordance with section 17 of the Act respecting the consolidation of the statutes (chapter R-3), chapter 47 of the statutes of 1973, in force on 31 December 1977, is repealed, except sections 14 to 20 and 22, effective from the coming into force of chapter T-5 of the Revised Statutes.
