DIVISION
I
ROADS AND STREETS IN CITIES AND TOWNS

The right to use as public highways all roads, streets and public highways within any city or town in Québec is vested in their respective municipal corporations, except in so far as the right of property or other right in the land occupied by such highways has been expressly reserved by those previously interested therein when they originally ceded such land to serve as aforesaid, and except as to any concession road or cross road within the city or town where the persons in possession or those under whom they claim have laid out streets in such city or town without any compensation therefor in lieu of such concession or side road.

Such roads, streets and highways, so long as they remain open as such, shall be maintained and kept in proper repair by and at the cost of such corporation, whether they were originally opened and made by such corporation, or by the Government, or by any other authority or person.

If the municipal corporation of any city or town fail to keep in repair any such road, street or highway within the limits thereof, such corporation shall be liable to a fine of $50 to $2 000 before which the conviction is had; and such corporation shall be also civilly responsible for all damages sustained by any person by reason of such default, provided the action for the recovery of such damages be brought within six months after the same have been sustained.

REPEAL SCHEDULE
In accordance with section 17 of the Act respecting the consolidation of the statutes (chapter R-3), chapter 179 of the Revised Statutes, 1964, in force on 31 December 1977, is repealed effective from the coming into force of chapter R-27 of the Revised Statutes.
