The Minister of Education shall have charge of the carrying out of this act.

In this act, unless the context otherwise requires, the following terms shall have the following meaning:
(
a
)
“
scholarship
”
: the pecuniary assistance granted under this act for the period of one school year;
(
b
)
“
student
”
: a bachelor of arts or bachelor of pedagogy who has not had three years’ experience in teaching and wishes to pursue university studies in one of the subjects mentioned in paragraph
c
of section 5;
(
c
)
“
professor
”
: a bachelor of arts or bachelor of pedagogy who has had three years’ experience in teaching and wishes to pursue such studies;
(
d
)
“
teaching institution
”
: a secondary school governed by the Education Act (chapter I-14), an independent secondary school or classical college recognized by the Minister of Education;
(
e
)
“
universitarian institution
”
: a university or an institution affiliated with, incorporated in or annexed to it and providing education leading to the degrees of master, licentiate and doctor;
(
f
)
“
Minister
”
: the Minister of Education.

DIVISION
I
UNIVERSITY SCHOLARSHIPS

The Minister is authorized to grant each year, on the conditions and in the manner determined by this division and the regulations, scholarships to students and professors who wish to pursue university studies in order to hold one of the positions referred to in section 9.

The amount of the scholarship shall be $1 200 for a student, $2 500 for an unmarried professor and $3 500 plus $150 per child for a married professor.

Every candidate must apply in writing to the Minister and meet the following conditions:
(
a
)
be a Canadian citizen domiciled in Québec;
(
b
)
have succeeded in his studies or in teaching, as the case may be;
(
c
)
be enrolled or undertake to enroll in a universitarian institution of Québec, there to pursue, on a full-time basis, with a view to securing a university degree requiring at least three years of study after the bachelor of arts degree or at least two years after the bachelor of pedagogy degree, studies either in a subject on the curriculum of a teaching institution, or in school and vocational guidance, or in school administration;
(
d
)
give the undertaking contemplated in section 9.

A jury appointed by the Minister shall examine and classify the candidates according to their ability to benefit from the studies for which they seek a scholarship.

The Minister shall determine each year the number of new scholarships, up to 300, and shall award them according to the classification made by the jury.

On the recommendation of the jury, the Minister shall grant a renewal of the scholarship of a student or a professor for not more than three further consecutive years.

To qualify for a scholarship, each candidate must undertake in writing to perform, for seven years after the completion of his studies, pedagogical duties in a teaching institution or in the Ministère de l’Éducation.
For the purposes of such undertaking, a minor may contract in the same manner as a person of the age of majority.

After each academic year following the completion of his studies, the holder of a scholarship must furnish the Minister with proof that he has fulfilled the undertaking contemplated by section 9, failing which he shall become subject to the provisions of section 11.

The holder of a scholarship who does not comply with his undertaking must repay in whole or in part, as the case may be, the amount received in scholarships. The amount that he must repay shall be determined according to the number of years during which he complied with his undertaking, in conformity with the following table:
In case of death, the obligation to repay shall lapse.

The amount that the holder of a scholarship is bound to repay shall bear interest at the rate of three per cent per annum from the end of the school year in which he failed to comply with his undertaking.
The terms of repayment shall be fixed by regulation.

DIVISION
II
RESEARCH SCHOLARSHIPS

The Minister is authorized to grant, each year, on the conditions and in the manner determined by this division and the regulations, scholarships to persons who wish to carry on research pertaining to teaching with a view to a doctor’s degree in one of the branches mentioned in section 15.

The maximum amount of each scholarship shall be $3 000 for an unmarried person and $4 000 plus $150 per child for a married person.

Every candidate must apply in writing to the Minister and meet the following conditions:
(
a
)
be a Canadian citizen domiciled in Québec;
(
b
)
hold a degree of master or licentiate, either in a subject on the curriculum of a teaching institution or in one of the following branches: pedagogy, psychology, sociology, law, economics;
(
c
)
be enrolled or undertake to enroll in a universitarian institution approved by the jury, there to pursue, on a full-time basis, studies leading to a doctor’s degree.

A jury appointed by the Minister shall examine and classify the candidates according to their ability to benefit from the studies for which they seek a scholarship.

The Minister shall determine each year the number of new scholarships for each subject or branch and shall award them according to the classification made by the jury.

On the recommendation of the jury, the Minister shall grant the renewal of a scholarship for a second year and, in exceptional cases, for a third year.

To qualify for a scholarship under this division, each candidate must undertake in writing, for a period of seven years after the completion of his studies, to carry on research respecting teaching or to perform teaching duties determined by regulation, in a Québec university, in the Ministère de l’Éducation or in another institution approved by the Minister.
The second paragraph of section 9 and sections 10, 11 and 12 shall apply to the undertaking contemplated by this section.

DIVISION
III
ASSISTANCE TO UNIVERSITARIAN INSTITUTIONS

The Minister is authorized to grant, on the conditions and in the manner determined by this division and the regulations, pecuniary assistance to universitarian institutions of Québec for the training of the holders of the scholarships granted under division I.

The pecuniary assistance granted for all the subsidized institutions shall not exceed the sum of $200 000 per annum.

Such assistance shall be appropriated as follows:
(
a
)
part thereof shall be allotted to institutions proportionately to the number of holders of scholarships who attend such institutions;
(
b
)
another part thereof shall be granted to institutions that whish to obtain the services of professors from outside Québec and are not able to meet the whole cost thereof; such assistance shall not exceed the additional expenses incurred for such purpose by each institution.

DIVISION
IV
GENERAL PROVISIONS

The Government may make regulations for the carrying out of this act.
Such regulations may recognize for the purposes of this act certain diplomas as equivalent to the degree of bachelor of arts or bachelor of pedagogy.

This Act shall operate notwithstanding the provisions of sections 2 and 7 to 15 of the Constitution Act, 1982 (Schedule B of the Canada Act, chapter 11 in the 1982 volume of the Acts of the Parliament of the United Kingdom).

REPEAL SCHEDULE
In accordance with section 17 of the Act respecting the consolidation of the statutes (chapter R-3), chapter 241 of the Revised Statutes, 1964, in force on 31 December 1977, is repealed, except section 2 (
part)
, effective from the coming into force of chapter B-7 of the Revised Statutes.
