APPLICATION

This Regulation applies to competitions for recruitment and promotion held under the Public Service Act (chapter F-3.1.1) and to candidate inventories constituted under the Act.

EVALUATION COMMITTEES AND RESOURCE PERSONS

The duties related to the holding of a competition or to the constitution of a candidate inventory may be performed in whole or in part by an evaluation committee or a resource person. Such a committee or person shall make recommendations in writing.
A person who is a member of an evaluation committee or a resource person shall be selected with respect to his knowledge of the position for which the competition is held or for which the candidate inventory is constituted, his experience in personnel management or selection and his professional competence.

The following may not act as resource persons or as members of an evaluation committee:
(
1
)
staff of the Lieutenant-Governor’s office;
(
2
)
staff of a minister’s office;
(
3
)
staff of the office of a person covered by the first paragraph of section 124.1 of the Act respecting the National Assembly (chapter A-23.1); and
(
4
)
Members of the National Assembly and their staff.

CONDITIONS OF ELIGIBILITY

1
. —
Geographical areas and administrative units

.
For purposes of this Regulation, a geographical area is:
(
1
)
a regional area corresponding to a region described in the Décret concernant la révision des limites des régions administratives du Québec (chapter D-11, r. 1);
(
2
)
a local area corresponding to a municipality governed by any Act, an unorganized territory or an Indian reserve;
(
3
)
a regional area to which is added another regional or local area;
(
4
)
a local area to which is added another local area.

Eligibility for a competition or a candidate inventory may be restricted to a geographical area, in consideration of the following criteria:
(
1
)
the mobility of the available labour force;
(
2
)
a sufficient number of applications by eligible persons;
(
3
)
the characteristics of the position to be filled.

Where a competition for promotion is held, or an inventory of candidates for the promotion is constituted, eligibility may be restricted, in consideration of the criteria listed in section 7, to persons belonging to the administrative unit for which the competition is held or for which the candidate inventory is constituted and to persons on reserve who would otherwise belong to that administrative unit.
For the purposes of this Regulation, an administrative unit is a department and the bodies under the responsibility of the minister of that same department or the National Assembly and the bodies under its responsibility.
Notwithstanding the second paragraph, the following are separate administrative units:
(

)
the Commission de la santé et de la sécurité du travail;
(
2
)
the Société de l’assurance automobile du Québec;
(
3
)
the Régie de l’assurance maladie du Québec;
(
4
)
the Régie des rentes du Québec; and
(
5
)
the Sûreté du Québec.

A person’s eligibility is related to his belonging to the geographical area or, as the case may be, the administrative unit set forth in the conditions of eligibility for the competition or entry on a candidate inventory.
A person is considered to belong to a geographical area where:
(
1
)
his principal residence is located therein, in the case of recruitment;
(
2
)
his principal residence or his base is located therein, in the case of promotion.

Notwithstanding section 9, for recruitment purposes and in the circumstances provided for in an affirmative action program or in a program designed to ensure the hiring of handicapped persons, the eligibility of a person covered by the program may not be restricted because that person belongs to another geographical area than the one specified in the conditions of eligibility.
For promotion purposes and under the circumstances provided for in a positive action program, the eligibility of a person covered by the program may not be restricted because he belongs to an administrative unit other than that specified in the conditions of eligibility.

Particular conditions

.
In the case of a competition held on the basis of a candidate inventory, only those candidates meeting the particular conditions of eligibility for the competition shall be considered.

NOTICE OF COMPETITION

The period allowed for the filing of applications for a competition or a candidate inventory shall be at least 10 working days. The closing date shall be indicated in the call for candidates.

This Division shall not apply to a competition held exclusively on the basis of a candidate inventory.

FILING OF APPLICATIONS

.
Applications shall be made in writing and include the information and documents specified in the notice of competition so that eligibility may be determined.

Only applications received during the period prescribed for filing applications shall be considered.
By reason of a failure on the part of the postal service or of any unforeseeable event delaying the receipt of application documents, an application received after the application period shall be considered.

ELIGIBILITY

.
A person who meets the conditions of eligibility set forth in the notice of competition or constitution of a candidate inventory shall, at a given time during the period for filing applications, be declared eligible.
Eligibility shall be determined by studying a person’s application form and the required supporting documents.

Notwithstanding section 21, a person who meets the specific conditions of eligibility for a competition held on the basis of a candidate inventory shall, at a given time during the period set for determining eligibility, be declared eligible.
Eligibility shall be determined by studying the person’s application for entry on a candidate inventory and the required supporting documents.
A person who is eligible for a candidate inventory shall be responsible for updating his application form and the required supporting documents.

Only knowledge of a language other than French may be a criterion for disqualifying applicants in a competition where such knowledge is considered essential to the carrying out of certain duties of the position.

The result a person obtains on an examination or part of an examination for a competition or the constitution of a candidate inventory may be transferred to any competition or candidate inventory where the following 2 conditions are met:
(
1
)
the content of the examinations or parts of examination is identical; and
(
2
)
the period between the dates of those examinations or parts of examination does not exceed 12 months.

In setting the pass mark for an evaluation procedure, the following criteria shall be considered:
(
1
)
the recommendation submitted concerning the pass mark prior to the application of the procedure;
(
2
)
an analysis of the results of all the participants in that procedure;
(
3
)
the relative value of the procedure with respect to the value of the overall evaluation procedure;
(
4
)
the number of positions to be filled.

A person who fails to obtain a pass mark shall be eliminated from the competition.
Except in the case of disqualification criteria, an evaluation procedure may disqualify an applicant only where it meets one of the following conditions:
(
1
)
it counts for at least 25% of the overall value of the procedure;
(
2
)
it allows the evaluation of at least one-quarter of the evaluation criteria selected.

USE OF CANDIDATE INVENTORIES

A candidate inventory may be used for a period of 2 years from the date of its constitution. Notwithstanding the foregoing, the period for using the candidate inventory may be extended, each extension corresponding to 1 year, by taking the following criteria into consideration:
(
1
)
the number of applicants eligible for the candidate inventory or whose eligibility is established by the evaluation, as the case may be, who have not yet been declared qualified;
(
2
)
the number of positions likely to be filled after competitions are held from the candidate inventory; and
(
3
)
the appropriateness of the evaluation procedure used in relation to the nature of the position.

QUALIFICATIONS LIST

A qualifications list has effect from the date it is approved by a person authorized to do so.

A qualifications list is valid for 1 year from the date on which it takes effect. However, a person authorized to approve that list may extend the validity period, each extension corresponding to 1 year, in consideration of the following criteria:
(
1
)
the number of qualified applicants not yet selected;
(
2
)
the foreseen number of positions to be filled;
(
3
)
the appropriateness of the evaluation procedure used in relation to the nature of the position.

A qualifications list is valid only for the purposes set forth in the notice of competition.

A person shall remain on a qualifications list for a competition only until his first appointment to a position.
Notwithstanding the first paragraph, a person who has not obtained permanent employee status and who is dismissed or laid off for lack of work or because a person placed on reserve has been assigned or transferred to the position, remains on the qualifications list from which he was appointed. The person is eligible for a new appointment from the list as long as it is valid.

Where more than one qualifications list is currently valid for the same position, geographical area or, as the case may be, the same department or body, either one of the lists may be used.
In the case of promotions, a qualifications list used to fill positions within a department or a body shall have priority over another qualifications list for filling positions in all departments and bodies.
