Regulation respecting fees exigible under the Highway Safety Code and the return of confiscated objects
Highway Safety Code
(chapter C-24.2, s. 624, 1st par., subpars. 1 to 5, 7 to 11 and 13 to 16).
The fees prescribed in the Regulation have been indexed as of 1 January 2014 pursuant to the notice published in Part 1 (French) of the Gazette officielle du Québec of 7 December 2013, page 1315. (ss. 2, 2.2, 2.3, 2.4, 2.5, 2.6, 3, 4, 4.2, 5, 6, 6.1, 6.2, 7, 8, 9, 11, 12, 12.1, 12.2)
DIVISION 1
INTERPRETATION
1. Unless otherwise indicated, legislative or regulatory provisions referred to in this Regulation shall be interpreted by taking into account any amendments that will be made to such provisions.

DIVISION 2
FEES EXIGIBLE UPON REGISTRATION OF A ROAD VEHICLE, FOR THE RIGHT TO OPERATE THE VEHICLE AND RETENTION OF THAT RIGHT

2. The fees exigible are:
(1)  $8.60 for the issue of registration for a road vehicle other than those covered by paragraphs 4 to 7 and for the right to operate the vehicle, and an additional $2.15 where the Société de l’assurance automobile du Québec must issue a new licence plate;
(2)  $0 in the case of a person who notifies the Société of storage or discarding of his vehicle;
(3)  $4.30 to retain the right to operate a road vehicle under section 31.1 of the Highway Safety Code (chapter C-24.2) where the owner pays by mail or through a financial institution that has entered into a contract with the Société for the sole purposes of collecting the fees exigible to retain the right to operate a road vehicle and the fees referred to in the first and second paragraphs of section 93.1 of the Code;
(3.1)  $7.55 to retain the right to operate a road vehicle under section 31.1 of the Highway Safety Code where the owner pays in an establishment of the Société or through a person authorized under section 9 of the Code to collect the fees exigible to obtain registration of a road vehicle and the right to put that vehicle into operation, as well as the fees to retain the right to operate a road vehicle;
(3.2)  $4.30 to obtain authorization to put a vehicle back into operation in the cases provided for in the fourth paragraph of section 31.1 of the Highway Safefy Code and in sections 68 and 72 to 75 of the Regulation respecting road vehicle registration (chapter C-24.2, r. 29), where the owner pays by mail or through a financial institution that has entered into a contract with the Société for the sole purpose of collecting the fees payable to retain the right to operate a road vehicle and the fees referred to in the first and second paragraphs of section 93.1 of the Code;
(3.3)  $7.55 to obtain authorization to put a vehicle back into operation in the cases provided for in the fourth paragraph of section 31.1 of the Highway Safety Code and in sections 68 and 72 to 75 of the Regulation respecting road vehicle registration, where the owner pays in an establishment of the Société or through a person authorized under section 9 of the Code to collect the fees payable to obtain the registration of a road vehicle and the right to put that vehicle into operation, as well as the fees payable to retain the right to operate a vehicle;
(4)  (paragraph implicitly revoked);
(5)  $4.30 upon temporary registration covered by sections 31 to 41 and 44 of the Regulation respecting road vehicle registration;
(6)  $2.15 upon temporary registration covered by section 45 of the Regulation respecting road vehicle registration;
(7)  $8.60 upon temporary registration covered by section 26 of the Regulation respecting road vehicle registration;
(8)  (paragraph implicitly revoked);
(9)  (paragraph implicitly revoked);
(10)  $10.80 for the replacement of a licence plate or a detachable licence plate; this fee covers the replacement of any validation stickers that must be affixed to the plate under the Highway Safety Code, as well as a registration certificate simultaneously replaced;
(11)  $4.30 for the replacement of a registration certificate other than one covered by paragraph 10;
(12)  $2.15 for the replacement of a validation sticker covered by section 6 of the Regulation respecting road vehicle registration.

2.1. (Revoked).

2.2. The fee payable is $43 for each of the vehicle registration operations listed below done in a Société establishment or by mail where required for a road vehicle concerned in a fleet of vehicles:
(1)  the initial apportioned registration of a vehicle;
(2)  the addition of a vehicle to a fleet;
(3)  a change to the information concerning the name of the registrant, the number of axles on a vehicle, the unladen weight, the gross vehicle weight, the number of seats, the number assigned by the Commission des transports du Québec, the type of vehicle, its wheelbase, the fuel it uses, the engine horsepower rating, the vehicle’s purchase price, its lease rate on an annual basis or the passenger capacity;
(4)  the replacement of a vehicle;
(5)  the transfer of a vehicle to another fleet operated by the same carrier;
(6)  the addition of a Canadian province or an American state to the list of jurisdictions in which a vehicle is registered for apportioned travel;
(7)  a change to the distance reported during the previous year or to a distance estimate.

2.3. The fee payable for the replacement a vehicle’s apportioned registration certificate (IRP) is $21.50 when done in a Société establishment or by mail and $16.20 when done electronically.

2.4. The fee payable for a vehicle registration operation enumerated in section 2.2 is $32.25 when done electronically.

2.5. The fee payable for renewal of a vehicle’s apportioned registration is:
(1)  $32.25 when the operation is done electronically;
(2)  $43 when the operation is done by mail;
(3)  $48.50 when the operation is done in a Société establishment.

2.6. The fee payable for a permit for travel with an unladen vehicle is $43.

DIVISION 3
ADDITIONAL FEE EXIGIBLE IN THE EVENT OF FAILURE TO PAY FEES OR INSURANCE CONTRIBUTIONS

3. The supplementary fee exigible for failure to pay, during more than 26 days, the registration fee, the additional registration fee, the motorist’s contribution to public transit and the fees covered by sections 68, 72 and 73 of the Regulation respecting road vehicle registration (chapter C-24.2, r. 29), and the insurance contribution covered by section 9 of the Regulation respecting insurance contributions (chapter A-25, r. 3.1) corresponds to the higher of:
(1)  $10.80; and
(2)  the amount calculated using the following formula:
F = S x I x J/360
where:
F: is the supplementary fee;
S: is the total of unpaid fees set under paragraphs 3.2 and 3.3 of section 2 and the unpaid registration fee, the unpaid additional registration fee and the motorist’s contribution to public transit covered by sections 68, 72 and 73 of the Regulation respecting road vehicle registration, and the unpaid insurance contribution covered by section 10 of the Regulation respecting insurance contributions;
I: is the interest rate corresponding to the rate determined under the first paragraph of section 28 of the Tax Administration Act (chapter A-6.002);
J: is the number of days during which the owner of a road vehicle is prohibited under the third paragraph of section 31.1 of the Highway Safety Code (chapter C-24.2) from putting his vehicle back into operation.
For the purpose of counting the number of days:
(1)  the last day of the months of January, March, May, July, August, October and December is not considered;
(2)  2 days are added to the number of days for February, but 1 in a leap year.

DIVISION 3.1
FEES EXIGIBLE FOR LICENCES TO DRIVE ROAD VEHICLES
O.C. 1423-91, s. 1.
4. Fees exigible in respect of licences to drive road vehicles are:
(1)  $6.45 for the issue of a driver’s licence authorizing the operation of only a moped, of a learner driver’s licence or of a restricted driver’s licence in paper form to the exclusion of one of these licences issued temporarily while pending the issue of a plastic driver’s licence. These fees are of $4.30 for any subsequent issue of an expired learner driver’s licence of the same class in paper form;
(2)  (subparagraph revoked);
(2.1)  $14.80 upon issue of a licence in plastic form with the holder’s photograph;
(2.2)  (subparagraph revoked);
(2.3)  $12.90 upon issue of a licence in plastic form without a photograph;
(2.4)  (subparagraph revoked);
(3)  $4.30 on payment of the fees referred to in the first and second paragraphs of section 93.1 of the Highway Safety Code (chapter C-24.2) where the person pays by mail or through a financial institution that has entered into a contract with the Société for the sole purpose of collecting the fees exigible to retain the right to operate a road vehicle and the fees referred to in the first and second paragraphs of section 93.1 of the Code;
(3.1)  $7.55 on payment of the fees referred to in the first and second paragraphs of section 93.1 of the Highway Safety Code where the person pays in an establishment of the Société or through a person authorized to collect those fees under section 69.1 of the Code. Those fees are reduced to $4.30 where the person must go to one of these places to obtain, renew or replace a licence in plastic form;
(3.2)  $4.30 on payment of the fees referred to in the fourth paragraph of section 93.1 of the Highway Safety Code and in the cases provided for in sections 61.1, 63, 66 and 68 of the Regulation respecting licences (chapter C-24.2, r. 34), where the owner pays by mail or through a financial institution that has entered into a contract with the Société for the sole purpose of collecting the fees payable to retain the right to operate a road vehicle and the fees referred to in the first and second paragraphs of section 93.1 of the Code;
(3.3)  $7.55 on payment of the fees referred to in the fourth paragraph of section 93.1 of the Highway Safety Code and in the cases provided for in sections 61.1, 63, 66 and 68 of the Regulation respecting licences, where the person pays in an establishment of the Société or through a person authorized under section 69.1 of the Code to collect those fees. The fee is reduced to $4.30 where the person must go to one of these places to obtain, renew or replace a plastic-encased licence;
(4)  $4.30 for the replacement of a driver’s licence where it is illegible or damaged or destroyed or lost or stolen or where it contains inaccurate information, by a licence of the same category in paper form, except if the replacement is done at the request of the Société, in which case no fees are exigible;
(4.1)  $12.60 for the replacement of a driver’s licence where it is illegible or damaged, or destroyed or lost or stolen or where it contains inaccurate information, by a plastic licence of the same category, with the holder’s photograph, except if the replacement is done at the Société’s request, in which case no fees are exigible;
(4.2)  (subparagraph revoked);
(4.3)  $10.80 for the replacement of a licence referred to in subparagraph 4.1 by a plastic licence of the same category without a photograph except if the replacement is done at the Société’s request, in which case no fees are exigible;
(4.4)  $8.35 for the replacement, in circumstances not referred to in subparagraph 4.1, of a probationary licence or a driver’s licence by a plastic licence of the same category with the holder’s photograph taken by the Société;
(4.5)  (subparagraph revoked);
(4.6)  $6.45 for the replacement, in circumstances not referred to in subparagraph 4.1, of a probationary licence or a driver’s licence by a plastic licence of the same category without a photograph;
(4.7)  (subparagraph revoked);
(4.8)  $8.35 for the renewal of a plastic driver’s licence with a photograph of the holder and for any subsequent issue of an expired plastic apprentice driver’s licence of the same category with a photograph of the holder;
(4.9)  (subparagraph revoked);
(4.10)  $6.45 for the renewal of a plastic driver’s licence without the holder’s photograph and for any subsequent issue of an expired plastic leaner driver’s licence of the same class without a photograph of the holder;
(4.11)  $43 for the issue of a driver’s licence Plus in addition to the fees specified in subparagraph 2.1;
(4.12)  $43 for the renewal of a driver’s licence Plus in addition to the fees specified in subparagraph 4.8;
(4.13)  $2.15 for the replacement of a driver’s licence Plus which is illegible, damaged, destroyed, stolen or which contains mistaken information, by a driver’s licence Plus of the same category in addition to the fees specified in subparagraph 4.1;
(4.14)  $16.20 if a person does not report for an appointment made for the issue, replacement or renewal of a driver’s licence Plus, unless the person cancelled that appointment at least 48 hours ahead of time;
(5)  $19.20 for the issue of a probationary driver’s licence or a driver’s licence with the holder’s photograph in the cases specified in sections 90, 91, 91.1 and 91.3 of the Highway Safety Code;
(5.1)  $19.40 for the issue of a probationary driver’s licence or a driver’s licence with a photograph of the holder in the cases specified in section 92 of the Highway Safety Code;
(5.2)  (subparagraph revoked);
(5.3)  $17.20 for the issue of a probationary driver’s licence or a driver’s licence without a photograph of the holder in the cases specified in sections 90, 91, 91.1, 91.3 and 92 of the Highway Safety Code;
(6)  (subparagraph revoked);
(6.1)  for the taking of a proficiency examination, except if it is a test required by the Société under section 109 of the Highway Safety Code for which no fees are exigible;
(a)  $10.80 for a knowledge test or more than one knowledge test at a sitting;
(b)  $53.75 for the taking of a road test on a closed track for a class 1, 2 or 3 driver’s licence;
(c)  $27 for the taking of a road test on a closed track for a class 6A learner driver’s licence, a probationary licence or a class 6A, 6B or 6C driver’s licence;
(d)  $97 for the taking of a road test on a public roadway for a probationary licence or a driver’s licence of class 6A, 6B or 6C;
(e)  $27 on the taking of a road test for a probationary licence or driver’s licence of a class other than those covered by subparagraphs b to d;
(7)  (subparagraph replaced);
(8)  (subparagraph replaced);
(8.1)  (subparagraph replaced);
(8.2)  (subparagraph replaced);
(9)  (subparagraph replaced);
(10)  (subparagraph revoked);
(11)  $21.50 on the failure by a licence applicant to keep an appointment for a road test unless he cancels the appointment at least 48 hours ahead of time.
The fee payable to obtain, renew or replace a plasticized licence given priority processing is increased by $21.50.
No fees are exigible for a request to cancel a driver’s licence.

FEES EXIGIBLE RELATED TO THE HEALTH INSURANCE CARD ISSUED BY THE RÉGIE DE L’ASSURANCE MALADIE DU QUÉBEC

4.0.1. The fees exigible for taking the photograph of a person who is having the Société, or a person designated by it under section 69.1 of the Highway Safety Code (chapter C-24.2), authenticate an application for renewal of registration with the Régie de l’assurance maladie du Québec or for the replacement of a health insurance card, are the same as those exigible by the Board for the same service under section 8.4 of the Regulation respecting forms and statements of fees under the Health Insurance Act (chapter A-29, r. 7).
No fees are exigible if the person is required, on such occasion, to replace a licence by a licence bearing the person’s photograph.

DIVISION 3.1.1
FEE FOR INSTALMENT PAYMENT BY PRE-AUTHORIZED DEBITS

4.1.1. A person who uses pre-authorized debits for instalment payment of vehicle registration or driver’s licence fees must, in addition to the fees exigible under the Regulation, pay interest charges.
The interest charge on each debit is calculated using this formula:
F = S x I x J/360
where:
F: is interest;
S: is the outstanding balance;
I: is the interest rate corresponding to the rate determined under the first paragraph of section 28 of the Tax Administration Act (chapter A-6.002), in force:
(1)  on the 60th day preceding the due date for the first debit payment, with respect to the fees exigible under the first paragraph of section 93.1 of the Highway Safety Code (chapter C-24.2);
(2)  on the day of issue of a probationary licence, of a restricted licence issued under section 76 of the Highway Safety Code or of a driver’s licence, with respect to the fees exigible upon issue of that licence;
(3)  on the first day of the month preceding the month of the due date under sections 19 and 21 to 24 of the Regulation respecting road vehicle registration (chapter C-24.2, r. 29):
(a)  with respect to the fees exigible to retain the right to operate a registered vehicle and the fees exigible for the apportioned registration of a vehicle, on condition there not be any other payments by pre-authorized debit due on the same date for other amounts exigible;
(b)  with respect to the fees exigible upon issue of a vehicle’s registration or the fees exigible for a change to a vehicle’s registration, where the period for which the fees are payable ends on the due date for debit payment of the fees exigible to retain the right to operate another of the owner’s vehicles for which payment is made by pre-authorized debit;
(4)  on the day of issue of a vehicle’s registration, with respect to the fees exigible upon issue of the registration of a vehicle other than one covered by subparagraph b of subparagraph 3 and with respect to the fees exigible for any subsequent registration and with respect to the fees exigible to retain the right of travel with a vehicle for which payment by pre-authorized debit is done subsequently, where the period for which the latter amounts are payable ends on the due date for payment of the first amounts;
J: represents:
(1)  0, for the first debit payment, with respect to the fees exigible to retain the right to operate a registered vehicle and the fees exigible under the first paragraph of section 93.1 of the Highway Safety Code;
(2)  for the first debit payment, with respect to the fees exigible upon issue of a vehicle’s registration, for a change to a vehicle’s registration, on issue of a probationary licence, of a restricted licence under section 76 or of a driver’s licence, the number of days from the date of registration issue or change or licence issue through the date of the next debit payment;
(3)  for the second debit payment, with respect to the fees exigible to retain the right of travel with a vehicle and the fees exigible under section 93.1 of the Highway Safety Code for which payment is in default for not more than 26 days, the number of days from the payment due date through the date of the second debit payment;
(4)  for debit payments not covered by subparagraphs 1 to 3, the number of days from the date of the last debit payment through the date of the next debit payment.
For the purpose of counting the number of days:
(1)  the last day of the months of January, March, May, July, August, October and December is not considered;
(2)  2 days are added to the number of days for February, but 1 in a leap year;
(3)  days entering into the calculation of the supplementary fee for default of payment under sections 3 and 4.2 shall not be considered.

DIVISION 3.2
ADDITIONAL FEE EXIGIBLE IN THE EVENT OF FAILURE TO PAY FEES OR INSURANCE CONTRIBUTIONS

4.2. The supplementary fee exigible for failure to pay, during more than 26 days, the fees and the insurance premium covered by sections 61.1, 63, 66 and 68 of the Regulation respecting licences (chapter C-24.2, r. 34), and the insurance contribution covered by sections 18 to 21 of the Regulation respecting insurance contributions (chapter A-25, r. 3.1), corresponds to the higher of:
(1)  $10.80; and
(2)  the amount calculated using the following formula:

DIVISION 4
FEES EXIGIBLE IN RESPECT OF MECHANICAL INSPECTIONS AND PREVENTIVE MAINTENANCE

5. The fees exigible in respect of mechanical inspections carried out by the Société are:
(1)  $27 for a mechanical inspection of:
(a)  vehicles referred to in subparagraphs 1, 2, 8, 9, and 11 of section 521 of the Highway Safety Code (chapter C-24.2);
(b)  taxis and minibuses;
(c)  passenger vehicles designated by a peace officer under subparagraph 10 of section 521 of the Highway Safety Code;
(d)  commercial vehicles defined in the Regulation respecting road vehicle registration (chapter C-24.2, r. 29) and designated by a peace officer under subparagraph 10 of section 521 of the Highway Safety Code;
(2)  $37.75 for the inspection of:
(a)  vehicles referred to in subparagraph 5 of section 521 of the Highway Safety Code;
(b)  buses;
(c)  trucks and equipment transport vehicles as defined in the Regulation respecting road vehicle registration, as well as tool vehicles, that are designated by a peace officer under subparagraph 10 of section 521 of the Highway Safety Code;
(3)  $5.40 for the issue of an inspection sticker.

6. The fee exigible from persons authorized to carry out mechanical inspections of road vehicles on behalf of the Société is $269 for each inspection site owned or leased by such persons.
No fee is exigible for the renewal of an authorization to carry out mechanical inspections.

6.1. The fee exigible for study of an application for recognition of a preventive maintenance program is $80.75.

6.2. The purchase price of a sticker validating preventive maintenance program recognition is $5.40.

DIVISION 5
FEES EXIGIBLE FROM DEALERS AND RECYCLERS OF ROAD VEHICLES
7. The fees exigible from dealers and recyclers of road vehicles are:
(1)  $215 for the issue of a dealer’s licence;
(2)  $215 for the issue of a recycler’s licence;
(3)  $323 for the issue of a dealer-recycler’s licence;
(4)  $162 for renewal of a dealer’s licence;
(5)  $162 for renewal of a recycler’s licence;
(6)  $27 for replacement of a dealer’s licence;
(7)  $27 for replacement of a parts recycler’s licence.
The fee exigible for renewal of a dealer’s and a recycler’s licence on the same date is reduced to $242.

DIVISION 6
FEE EXIGIBLE FOR AFFIXING AN IDENTIFICATION NUMBER TO A ROAD VEHICLE
8. The fee exigible for affixing an identification number to a road vehicle is $32.25.

DIVISION 7
FEES EXIGIBLE FOR THE ISSUE OF AN IDENTIFICATION STICKER UNDER SECTION 11 OF THE CODE
9. The fee payable to obtain, renew or replace handicapped parking identification covered by section 11 of the Highway Safety Code (chapter C-24.2) and its accompanying certificate is $16.20.
The fee payable for replacing the certificate, issued by the Société to attest that the holder qualifies for handicapped parking identification is $4.30.

DIVISION 8
FEE EXIGIBLE FOR CHEQUES WITHOUT SUFFICIENT FUNDS AND CHEQUES RETURNED
10. Whoever pays by means of a cheque that the financial institution on which it is drawn refuses to honour, because of insufficient funds or for any other reason, shall pay the fees set by the first paragraph of section 12.2 of the Tax Administration Act (chapter A-6.002).

DIVISION 9
FEES EXIGIBLE IN RESPECT OF SPECIAL PERMITS
11. The fees exigible in respect of special permits are:
(1)  $10.80 for the issue of a special permit; and
(2)  $4.30 for its replacement.

DIVISION 10
FEE EXIGIBLE AND CONDITIONS FOR THE RETURN OF OBJECTS CONFISCATED OR TAKEN
12. Upon payment of a $21.50 fee, the Société shall return to its owner an object confiscated or taken, if the owner files an application therefor in writing within 90 days of the date on which the object was confiscated or taken, and if he
(1)  produces a final judgment of acquittal in respect of a charge relating to that object, or produces a document attesting that the charge has been withdrawn; or

12.1. The fee payable for obtaining information from the Société under section 611.1 of the Highway Safety Code (chapter C-24.2) is $1.60 per information request.
The fee for each information request made electronically covering more than 5 records is $0.25 per information on a record starting from the sixth; the fee is $0.55 from the sixth for a request made on paper.
The fee set under this section cannot exceed that prescribed by section 6 of the Regulation respecting fees for the transcription, reproduction or transmission of documents or personal information (chapter A-2.1, r. 3).
