Regulation respecting all-terrain vehicles
OFF-HIGHWAY VEHICLES — ALL-TERRAIN VEHICLES

This Regulation is deemed to be a regulation made under the Act respecting off-highway vehicles (chapter V-1.2).

Any person riding on an all-terrain vehicle or a learner’s vehicle must wear a protective helmet meeting the standards prescribed by the Protective Helmets Regulation (chapter C-24.2, r. 6) as well as shoes or boots.

No person may drive an all-terrain vehicle where the lights, the muffler or the mudguards installed by the manufacturer have been modified, removed or rendered inoperative, except where such vehicle is driven on a race track recognized by a federation of all-terrain vehicle clubs.
No person may drive a learner’s vehicle where a piece of equipment or an accessory installed by the manufacturer has been modified, removed or rendered inoperative.

Where an all-terrain vehicle is a trail bike capable of transporting a passenger, such passenger must be seated facing in the direction of the handlebars with his feet resting on the footrests while the vehicle is in motion.

No person may drive an all-terrain vehicle or a learner’s vehicle where the registration plate is not securely attached to the rear of the vehicle or is not free of any object or substance that could prevent it from being read.

No person may get on or off an all-terrain vehicle or a learner’s vehicle while it is in motion or allow anyone else to do so.

No occupant of an all-terrain vehicle or a learner’s vehicle may consume alcoholic beverages while on the vehicle.

No person may cling to or hang on to an all-terrain vehicle or a learner’s vehicle while it is in motion.
The driver of an all-terrain vehicle or a learner’s vehicle may not permit anyone to cling to or hang on to his vehicle while it is running.
