Regulation respecting other terms and conditions for permits of the Ordre des technologues en imagerie médicale et en radio-oncologie du Québec to be issued

DIVISION I
GENERAL
1. In this Regulation, unless the context indicates otherwise,
(1)  “permit” means the permit referred to in section 9 of the Act respecting medical imaging technologists and radiation oncology technologists (chapter T-5);
(2)  “registrar” means the registrar of the Order.

DIVISION II
GENERAL PRINCIPLE
2. In order to obtain the permit issued by the Ordre des technologues en imagerie médicale et en radio-oncologie du Québec in accordance with the Professional Code (c. C-26), every candidate must hold a diploma recognized as valid for that purpose by the Government or recognized as equivalent by the board of directors, pass the admission examination and fulfil the conditions and formalities provided for in this Regulation.

DIVISION III
EXAMINATION COMMITTEE
3. The examination committee shall be composed of members appointed by the board of directors from among those whose names appear on the roll of the Order.

4. The committee is responsible for ensuring that questions are prepared and that the examination is drawn up, supervised and marked, and for making its recommendations to the board of directors.

5. The members of the committee shall be appointed for a 2 year period and their mandate is renewable.

DIVISION IV
ELIGIBILITY FOR THE EXAMINATION
6. In order to be eligible for the examination, candidates must meet the conditions for obtaining the diploma giving entitlement to the permit or recognized as equivalent by the board of directors.

7. The registrar shall notify candidates in writing of whether they are eligible for the examination.

DIVISION V
EXAMINATIONS
8. Examinations shall be held at least twice a year on the days and dates and at the times determined by the board of directors.

9. The registrar shall notify candidates in writing of the date, time, place and method of examination determined by the board of directors following recommendations by the examination committee.

10. In order to register for the examination, a candidate must send the registrar, at least 30 days prior to the date set for the examination, the following documents:
(1)  the duly completed registration form appearing in Schedule I;
(2)  his academic record;
(3)  an attestation that he will hold a diploma giving entitlement to the permit issued by the Order or a diploma recognized as equivalent by the board of directors;
(4)  a recent photograph measuring 5 cm by 5 cm and certified by his signature as being his;
(5)  a certified cheque or postal money order covering the registration fee determined by the board of directors.

11. A candidate who is ruled ineligible for the examination on the grounds that he has not met the conditions referred to in section 6 may have the examination registration fee reimbursed, less an administration fee of $50, if he sends the registrar a written application to that effect at least 7 days prior to the examination date.

12. An eligible candidate who fails to appear for the examination is not entitled to have his registration fee reimbursed; however, the amount of that fee may be credited to him if he later takes the examination within 2 years.

13. The examination, the purpose of which is to ascertain a candidate’s knowledge in any of the 3 categories listed in this section chosen by the candidate, shall bear respectively on one or more of the following subjects described under each category:
(1) Radiodiagnostic
Radiographic techniques and medical imaging, legislation respecting the professions, care of the health services user, radiology, pathology, radiological anatomy, anatomy and physiology, physics-apparatus, image recording, radiobiology and radiation protection, quality control, specific pharmacology;
(2) Radiation oncology
Physics-apparatus, radiobiology, radiation protection, care of the health services user in radiology, anatomy, physiology, pathology, applied radio therapy, treatment planning, legislation respecting the professions, dosimetry, specific pharmacology, image recording and quality control;
(3) Nuclear medicine
Radiobiology, radiation protection, legislation respecting the professions, care of the health services user in radiology, physics-apparatus and instrumentation, radiopharmacology, applied nuclear medicine, anatomy, physiology, pathology, nuclear medicine procedures, quality control, pharmacology.

14. The examination, which requires the knowledge and skills acquired by the candidate during his basic training, is intended to evaluate the candidate’s behaviour and decision-making in a given situation, as well as his ability to use his knowledge autonomously in an emergency situation or in any other situation peculiar to the practice of the profession of medical imaging technologist or radiation oncology technologist.

15. In writing the examination, a candidate may use French or English.

16. The examination of a candidate who plagiarizes, attempts to plagiarize or helps another candidate to plagiarize may be invalidated by decision of the board of directors.

17. The passing grade for the examination is 60%.

18. The marks obtained by a candidate shall be sent to him by the registrar, after authorization from the chair of the examination committee and the president of the Order.

19. Copies of the examination papers and of the candidates’ answers, the reports of the examination committee and the marks given to each candidate shall be kept by the registrar for one year.

20. A candidate who fails the examination may, within 30 days of being notified of the results, request that the review committee review the evaluation and marking of his examination. The candidate must send his application for review to the registrar in writing.
The application shall be processed in accordance with the procedure established by the board of directors and the review committee’s decision shall be forwarded to the candidate by the registrar.

21. A candidate who wishes to take a supplemental examination must send the registrar, at least 60 days prior to the examination date set by the board of directors, in accordance with section 8:
(1)  the duly completed supplemental examination registration form appearing in Schedule II;
(2)  a certified cheque or postal money order covering the fee set by the board of directors, that fee being non-refundable.

21.1. A candidate who fails the examination may sit for any of the following sessions. He may sit for a maximum of 3 supplemental examinations, unless he demonstrates to the satisfaction of the examination committee, that he has successfully completed an additional period of training aimed at correcting his deficiencies.

DIVISION VI
PERMIT
22. In order to obtain a permit to practise the profession, a candidate who passes the examination for admission to the profession must submit a written request to the Order in the form provided for in Schedule III, accompanied by:
(1) a certified true copy of a diploma recognized as valid for that purpose by the Government or recognized as equivalent by the board of directors;
(2) a recent photograph measuring 5 cm by 5 cm and certified by his signature as being his;
(3) proof, where so required by law, that the has an appropriate knowledge of the French language, in accordance with section 35 of the Charter of the French language (chapter C-11);
(4) a certified cheque or postal money order covering the amount of the annual assessment established in accordance with section 85.1 of the Code.

FINAL
23. This Regulation replaces the Regulation respecting admission to the profession of radiology technologist (R.R.Q., 1981, c. T-5, r. 1).
