The purpose of this Regulation is to establish the classes of teaching licences the Minister may determine pursuant to section 23 of the Education Act (
chapter I-13.3
), the activities those classes allow and, as applicable, their period of validity and attendant restrictions.
A further purpose is to determine the diplomas or other training conditions that lead to teaching licences, as well as the procedure for obtaining or renewing a teaching licence.

CLASSIFICATION OF TEACHING LICENCES

The Minister may issue teaching licences for general education, preschool education, elementary and secondary level teaching, and secondary level vocational training. The teaching licences are valid for all school boards and for the institutions governed by the Act respecting private education (
chapter E-9.1
) or are restricted to specific school boards.

The teaching licences valid for all school boards and the institutions referred to in section 2 are the general education teaching diploma and the vocational training teaching diploma.

The teaching licences valid for specific school boards only are the general education teaching diploma for Cree and Kativik school boards and the general education teaching diploma for the Kativik School Board.
The general education teaching diploma for Cree and Kativik school boards and the general education teaching diploma for the Kativik School Board authorize the holder to provide preschool education services or to teach at the elementary or secondary level in the school boards specified on the diploma.
The diplomas are permanent, subject to the powers the Minister may exercise under the Education Act (
chapter I-13.3
).

The Minister may also issue probationary teaching permits to applicants for whom supplementary training requirements are imposed pursuant to this Regulation in order to obtain a teaching diploma, and issue provisional teaching licences to persons enrolled in a program leading to a teaching diploma.
The probationary permits and provisional teaching licences authorize the same teaching activities as the teaching diploma they lead to. They are valid for the time determined in this Regulation, subject to the powers the Minister may exercise under the Education Act (
chapter I-13.3
).

The following persons may be issued a general education teaching diploma:

the holder of a diploma listed in Schedule I;
(

)
the holder of a teaching licence for a level equivalent to preschool education or the elementary or secondary level, without conditions, issued in another Canadian province or territory; and

)
the holder of a probationary general education teaching permit who has satisfied the supplementary training requirements as provided in subdivision 2 of Division 1 of Chapter 4.

the holder of a diploma listed in Schedule II if the holder

has obtained a diploma of vocational studies, a diploma of college studies in a technical program, a university certificate comprising at least 30 credits or a university diploma directly related to the program to be taught in a sector of activities listed in Schedule III; and
(
b
)
has a minimum of 3,000 hours of practical experience or teaching in a trade directly related to the program to be taught;
(

)
the holder of a vocational training teaching licence, without conditions, issued in another Canadian province or territory; and
(
3
)
the holder of a probationary vocational training teaching permit who has satisfied the supplementary training requirements as provided in subdivision 2 of Division 2 of Chapter 4.

A probationary general education teaching permit is valid for 5 years and may be renewed for subsequent 5-year periods.
For a person referred to in section 12 or 13, the probationary permit is renewable only if the applicant has successfully met all the imposed requirements, except for the probationary period.
Despite the first paragraph, a renewal of a probationary permit following a failed probationary period is valid for one year only.

A probationary vocational training teaching permit issued pursuant to paragraph 1 or 2 of section 15 is valid for 5 years.
It may be renewed for subsequent 5-year periods on the following conditions:

the holder of a probationary permit issued pursuant to paragraph 1 of section 15 has successfully met all the requirements imposed, except for the probationary period, if applicable; and
(
2
)
the holder of a probationary permit issued pursuant to paragraph 2 of section 15 has passed the course on the Québec school system offered as part of a university teacher training program in vocational training listed in Schedule II or an equivalent course given by Télé-université du Québec.

In determining a diploma equivalence, the Minister may consider the number of years of schooling necessary to obtain the diploma and the number, nature and content of the courses taken and practicums served to obtain it.

If the Minister cannot recognize a full equivalence of a diploma the Minister considers to be substantially equivalent, the Minister may,
(
1
)
on the basis of the documents on file establishing the applicant’s professional experience or any other relevant fact, determine that the applicant has the competencies identified as missing; or
(
2
)
request the applicant substantiate, within the time the Minister specifies, the competencies identified as missing in a written document that must contain any relevant supporting documents pertaining to the applicant’s professional experience or that establish how the courses taken made it possible for the knowledge and qualifications to be acquired, or in other evaluation tools the Minister recognizes.

The Minister may refuse to recognize a diploma or competency equivalence or, in the likelihood that refresher training would enable the competencies identified as missing to be acquired, partially recognize the competencies. In the latter case, the Minister must set the training conditions to be satisfied by the applicant to have a full competency equivalence recognized.
Before refusing an equivalence or recognizing a partial equivalence, the Minister must allow the applicant to make written observations within the time the Minister specifies.
The second paragraph does not apply if the Minister has made a request pursuant to paragraph 2 of section 25.

Probationary period

The purpose of the probationary period is to verify the competence and professional qualifications of the person on whom it is imposed under any of Divisions 1 to 3 of Chapter 4.
The probationary period focuses primarily on
(
1
)
the ability to communicate orally and in writing in an efficient manner, and to develop, adapt, manage and evaluate teaching-learning situations designed to enable students to develop the competency described in the programs of studies approved by the Minister, making use of information and communications technologies;
(
2
)
the ability to establish a rapport with the students individually or as a group, to maintain an atmosphere and environment conducive to the development of competency and to consider individual differences of all types;
(
3
)
the ability to establish interpersonal relations with parents, the other members of the staff of the educational institution and the partners responsible for the implementation of the services; and
(
4
)
the ability to act ethically and responsibly in performing the various duties and to be committed to a personal or collective process of professional development.

The probationary period consists of 900 hours of teaching.
It may, however, consist of fewer than 900 but not fewer than 600 hours if the objective described in section 27 has been achieved.
To calculate valid hours of teaching for the purposes of the probationary period, only hours taught in the period during which the probationary permit is valid are considered, under contracts of at least 200 teaching hours over 12 consecutive months and in accordance with sections 29 and 30.

The probationary period must be served with only one employer that is
(
1
)
a school board constituted under an Act;
(
2
)
a private educational institution to which the Act respecting private education (
chapter E-9.1
) applies; or
(
3
)
an educational institution that has entered into an agreement with the Minister enabling teaching to be recognized for the purposes of the probationary period.
A probationary period served in a school board may be served in 2 or more of the school board’s institutions.

The probationary period begins on the signing of a teaching contract consisting of at least 200 hours taught over 12 consecutive months. If the initial contract does not cover all the hours required to complete the probationary period, the employer must be able to ensure that a sufficient number of similar contracts will be entered into within a reasonable time.
As soon as the initial contract begins, the teacher trainee and a person assigned by the employer to supervise the probationary period must agree on the specific terms of the probationary period that are to guide supervision of the teaching and evaluation of the competence and professional qualifications to be verified by the probationary period.
Instruction provided in a situation described in the second paragraph of section 23 of the Education Act (
chapter I-13.3
) is not considered for the purposes of calculating the number of hours of teaching in the probationary period required by section 28. The teacher trainee may as well offer services to another employer while not bound by a contract in order to complete the required number of hours of teaching. Such a contract must, however, be entered into for fewer than 200 hours. An applicant may also enter into such contracts before beginning the required probationary period.

The probationary period supervisor is to monitor the teacher trainee and evaluate the trainee’s competence and qualifications using the evaluation criteria provided by the Minister.
If the probationary period is served in 2 or more of a school board’s institutions, the principals who are not supervisors for the probationary period are to participate in the monitoring and evaluation of the teacher trainee in the manner indicated by the probationary period supervisor.

The probationary period supervisor is to provide the teacher trainee with a first progress report after 200 teaching hours and another similar report at the end of every employment contract.
Despite the foregoing, if the initial employment contract is for not more than 300 hours, the probationary period supervisor may decide to provide a progress report only at the end of the employment contract.
Every progress report must state the number of teaching hours it covers.
If a progress report indicates significant shortcomings, the probationary period supervisor is to make recommendations and set the appropriate measures in place to enable the teacher trainee to correct the shortcomings.

The probationary period supervisor is to furnish a final evaluation report at the end of the 900 hours in the probationary period.
The report may, however, be furnished as soon as the teacher trainee has taught for 600 hours if the probationary period supervisor is of the opinion that the teacher trainee has sufficiently mastered the competence and professional qualifications the probationary period seeks to verify.

The probationary period supervisor is to provide the final report to the employer who, after examining the report, concludes whether or not the probationary period objective has been attained. The employer then provides the report to the teacher trainee along with a certificate of achievement or a notice of failure, as applicable. The employer must send a copy of the report and, as applicable, the certificate or notice to the Minister.
A final report containing a notice of failure must specify the shortcomings observed and the reasons in support of the findings. It must also contain the appropriate recommendations to enable the teacher trainee to correct the shortcomings.

A person who fails a probationary period may serve a second probationary period if the person notifies the Minister in writing of the intention to do so within 60 days following receipt of the notice of failure. No further probationary period is possible if the person fails the second probationary period.
This subdivision applies to the second probationary period, with the necessary modifications, except that the duration of the second probationary period is 600 hours with no possible reduction of hours.

Notwithstanding any provision to the contrary, the probationary permit of a person who does not send the notice referred to in section 35 within the required time ceases to have effect on the expiry of the 60-day period set out in that section.
The same applies on failure of the second probationary period.
The Minister must notify the person who held the probationary permit of the permit expiry date as well as every school board or institution in which the person was a teacher trainee.

Every applicant for a teaching diploma or probationary permit must have passed the written French or English examination recognized by the Minister for the purpose.
The same applies to an applicant for a provisional teaching licence issued pursuant to paragraph 1 of section 43.

If the greater part of an applicant’s training was acquired in a language other than French or English, the applicant must also pass an examination assessing French or English comprehension and oral language proficiency.

This subdivision does not apply to an applicant to whom a teaching diploma or probationary permit is issued on the basis of a teaching licence issued in another province or a Canadian territory.

A provisional general education teaching licence may be issued to a person who
(
1
)
is in either of the following situations:
(
a
)
is enrolled in a teacher training program in general education recognized since 2001 and listed in Schedule I and who proves
i
.
that a bachelor’s degree or equivalent diploma has been obtained, excluding a university teacher training program in general education listed in Schedule I or IV;
ii
.
that at least 45 university-level credits have been earned in mathematics, French studies, English studies, Hispanic studies, ethics and religious culture, physical education, drama, visual arts, music, dance, science and technology in the fields of physics, chemistry and biology, or in social sciences in the fields of geography and history and citizenship education; and
iii
.
that at least 9 credits in education have been earned in the teacher training program in general education in which the person is enrolled, related to the person’s field of training, in educational psychology, in the teaching of a subject in the Basic school regulation for preschool, elementary and secondary education, in class management or intervention with handicapped students or students with social maladjustments or learning disabilities or in training on the Québec school system, including not more than 3 credits in each of the 3 subjects selected;
(
b
)
is enrolled in a teacher training program in general education, concentration in special education, recognized since 2001 and listed in Schedule I and who proves
i
.
that a bachelor’s degree in psychology, psychoeducation or remedial education has been obtained; and
ii
.
that at least 9 credits in education have been earned in the teacher training program in general education in which the person is enrolled, including three credits in educational psychology and 3 credits in the teaching of a subject in the Basic school regulation for preschool, elementary and secondary education; and
(
2
)
has a promise of employment from an employer referred to in section 29 certifying that, within the school year in progress, the person is to be given a general education teaching position directly related to the bachelor’s degree or training described in paragraph 1 for which a teaching licence is required and that the position cannot be filled by the holder of a teaching licence.

A provisional teaching licence to which section 40 refers is valid for a period of not more than 3 years and expires at the end of the second school year following the year in which it was issued.
It may be renewed for
(
1
)
a first period of 2 school years if its holder has earned at least 21 credits in education in the teacher training program, including one practicum, in general education referred to in section 40;
(
2
)
a second period of 2 school years if its holder has earned at least 33 credits in education, including 2 practicums, in the same program; and
(
3
)
a final period of one school year if its holder has earned at least 51 credits in education, including 3 practicums, in the same program.

A provisional general education teaching licence valid for a single period of not more than 3 years expiring at the end of the second school year following the year in which it was issued may be issued to a person who
(
1
)
is in either of the following situations:
(
a
)
is enrolled in a teacher training program in general education listed in Schedule I and is completing the fourth year of the program; or
(
b
)
has been awarded a partial diploma recognition pursuant to section 26;
(
2
)

(
a
)
a diploma of vocational studies, a diploma of college studies in a technical program, a university certificate comprising at least 30 credits or a university diploma directly related to the program to be taught in a sector of activities listed in Schedule III has been obtained;
(
b
)
the person has a minimum of 3,000 hours of practical experience or teaching in a trade directly related to the program to be taught; and
(
c
)
the language examination required by section 37 and, if applicable, the examination required by section 38 has been passed; or
(
2
)
has obtained a diploma of vocational studies, a diploma of college studies in a technical program, a university certificate comprising at least 30 credits or a university diploma directly related to the program to be taught in a sector of activities listed in Schedule III, and proves that

An applicant who is missing 3 additional credits from among the 15 required by the first paragraph may compensate for those credits by demonstrating that 250 hours have been taught for an employer referred to in section 29 if the hours are directly related to the training for which the provisional vocational training teaching licence has been obtained, or that 500 hours of relevant experience in the workplace have been accumulated.

Except where enrolment is suspended, the holder of a provisional teaching licence must notify the Minister as soon as the holder is in a situation described in the first paragraph.

Every person applying for a teaching licence must provide the Minister with the following information and documents:
(

)
the person’s name, Social Insurance Number, address, telephone number and if available, email address;
(
2
)
a certified copy of the person’s act of birth or birth certificate and if applicable, proof of change of name or, if it not possible to provide those documents, an affidavit explaining why they cannot be provided, and the person’s date and place of birth;
(
3
)
if the person was born outside Canada, proof of citizenship and that the person is a permanent resident or is authorized to work in Canada;
(
4
)
a copy of the person’s relevant diplomas, the licence to teach outside Québec, if applicable, and any other document relevant to consideration of the application and establishing proof of the person’s training and experience, such as a transcript, a document attesting to successful completion of training or an examination, a credential evaluation report issued by a competent body, a letter from an employer or any other proof of experience or teaching hours accumulated;
(

)
a promise of employment when required under this Regulation;
(
6
)
any decision of an authority in a province, territory or State or of an organization subjecting the practice of teaching to conditions;
(
7
)
the language in which the person received the training in support of the application; and
(
8
)
the judicial record declaration required by section 25.1 of the Education Act (

Every copy of a diploma, teaching licence, transcript or attestation of successful completion of training or an examination provided pursuant to this Chapter must be certified by the authority issuing the original document, unless the applicant proves that such certification is impossible to obtain, in which case a copy and an affidavit from the applicant to the effect that the copy is true to the original may be provided.
Every document provided pursuant to this Chapter and written in a language other than French or English must be accompanied by a French or English translation certified by a member of the Ordre professionnel des traducteurs, terminologues et interprètes agréés du Québec.

The Minister is to issue a teaching licence to any person who qualifies for the licence.
In addition to its title, the teaching licence must state
(

)
the identification number assigned to it;
(

)
the name of the holder;
(

)
the issue date and, if applicable, the expiry date;

if applicable, the fact that the holder is required to successfully complete a probationary period;
(
5
)
the language or languages of instruction in which the holder is proficient, after passing an examination required by this Regulation;

)
for a general education teaching licence, the levels authorized and if applicable, the subject for which the holder has been trained; and

)
for a vocational training teaching licence, the name of the program and the sector of activity listed in Schedule III corresponding to the holder’s training;

Renewal of a teaching licence or authorization issued under the former Regulation is, if applicable, subject to the relevant rules set out in this Regulation.
Despite the foregoing, if the application of a rule set out in this Regulation operates to prevent the renewal of a licence or authorization that would have otherwise been renewable under the former Regulation, the renewal rules of the former Regulation apply but only to the first renewal following the coming into force of this Regulation (2019-10-01).

Subject to the special rules in the second and third paragraphs, the issuance conditions for a teaching diploma set out in this Regulation apply to holders of probationary permits referred to in the second paragraph of section 59. In particular, a holder of a teaching licence issued without conditions in another Canadian province or territory may be issued an equivalent teaching diploma in accordance with the provisions of this Regulation without being required to prove the conditions under the former Regulation have been met.
A holder of a teaching licence issued subject to conditions in another Canadian province or territory may be issued an equivalent teaching diploma after demonstrating that conditions equivalent to those imposed on the holder in the other Canadian province or territory or under the former Regulation have been met.
A person who began to serve a probationary period before 1 October 2019 remains subject, for the remainder of that period, to the provisions of the Regulation respecting teaching licences (
chapter I-13.3, r. 2
), except that this Regulation applies to a person who begins to serve a second probationary period after that date.

— bachelor’s degree including at least 30 credits in early childhood, preschool education, special education and social adaptation (remedial education), psychoeducation or psychology, that includes or to which are added college or university-level courses on children health and safety and on the educational approach carried out in a recognized teaching institution.
