INTERPRETATION

.
In this Regulation, “lodging unit” means a lodging unit in a tourist accommodation establishment within the meaning of section 1 of the Regulation respecting tourist accommodation establishments (chapter E-14.2, r. 1).

In order to obtain an outfitter’s licence, a person must apply in writing to the Minister, on the form provided by the latter for that purpose and give the following particulars:
(
a
)
his name, address and the telephone numbers of his domicile and undertaking; in the case of a legal person or partnership, its name and the address of its main place of business; in the case of a natural person doing business under another name, that name, his name and the address of his undertaking;
(
b
)
his business number in the enterprise register established under the Act respecting the legal publicity of enterprises (chapter P-44.1);
(
c
)
this status as owner or lessee of the enterprise he is operating and, in the latter case, the owner’s name and address;
(
c
.1
)
where the applicant applies on behalf of a partnership or a legal person, he must also provide a written authorization to make the application and the name and address of each partner or shareholder; and
(
c
.2
)
the name of the insurance company that covers his civil liability for the risks related to the outfitting operation, except if it is operated by the Government, and the number and the amount of the insurance policy;
(
d
)
pay the fees payable for the issue of an outfitter’s licence determined by the Regulation respecting the scale of fees and duties related to the development of wildlife (chapter C-61.1, r. 32);
(
e
)
(paragraph revoked).

.
The holder of an outfitter’s licence must comply with the standards indicated in the licence relative to the number of lodging units that he may use and the capacity of each unit. He may use them only where they comply with the other standards provided for in this Regulation.

An outfitter’s licence is an annual licence and is valid from 1 April to 31 March of the following year.

.
An outfitter’s licence may be renewed where its holder:
(
a
)
sends the Minister his application for renewal on the form provided for that purpose by the Minister;
(
b
)
fulfils the conditions provided for in section 3;
(
c
)
pays the fees payable for its renewal determined by the Regulation respecting the scale of fees and duties related to the development of wildlife (chapter C-61.1, r. 32);
(
d
)
has filed the report referred to in section 42.

The holder of an outfitter’s licence must post the licence in a conspicuous place in the reception or registration area. He must also identify each lodging unit by a distinctive name, letter or number at the entrance of each unit.

The holder of an outfitter’s licence must also hold, for the term of his licence, civil liability insurance covering the risks related to the outfitting operation and comprising a coverage of at least $2,000,000.

Where the holder of an outfitter’s licence is a legal person, it must notify the Minister of any event bringing a change in the control of the legal person.

Transfer of licences

.
The rights conferred by a licence cannot be validly transmitted to another person unless the Minister has agreed to the transfer upon payment of the required fee and in conformity with this Regulation.

Any person seeking to transfer the rights conferred by an unexpired licence must apply in writing to the Minister on the form provided by the latter for that purpose.

REMODELING AND UPKEEP

.
No one may undertake to build, enlarge, change the use of or remodel a building, a lodging unit or a structure used for the purposes of an outfitting operation, nor acquire, lease or use another such building, lodging unit or structure or part thereof, nor increase the lodging capacity thereof, without an authorization from the Minister.
Upon the renewal of the outfitter’s licence, the latter shall be amended to take into account the changes referred to in the first paragraph.

Every outfitter must himself see to the security and supervision of his buildings and structures whenever they are open to the public, or entrust them to several competent and adult persons if their proper operation so requires.

Registration of visitors

.
Every outfitter must keep a register showing the name and address of each customer or guest, the date of his stay, and the name, letter or number of the lodging unit used and, where applicable, the number of his hunting, fishing or trapping licence and the game or fish taken.
The register must be kept for a period of at least 5 years from the date on which it is completed.
Every outfitter must, upon request, send a copy of the register to the Minister.

Every outfitter who is a lessee of exclusive rights must post up the indication of the place where every person must register where required to do so by section 41.2; that posting up must be done along the access roads or on the outskirts of the territory.

Every person must register at the place provided for that purpose by the outfitter where he carries on or has access to an activity of wildlife observation, photography, windsurfing, canoe-camping, hiking, horseback riding, cycling or riding motor vehicles, picking wild berries, bathing, spelunking or boating on a territory of an outfitter referred to in section 41.1 and during the period from 1 May to 1 November or from 1 May to 30 November for the territory of Île d’Anticosti; upon registration, that person must indicate his name, address, type of recreational activity planned, the date and place of the carrying on of the activity or access to the activity.
The first paragraph does not apply to a person who carries on or has access to an activity referred to therein on his trapping grounds located in a beaver reserve.

The holder of an outfitter’s licence must send the Minister, no later than 31 January of each year, an annual report on his activities.
The report must contain the following information:
(
1
)
the operating period;
(
2
)
a statement of income and expenses;
(
3
)
the number of customers;
(
4
)
the wildlife harvest;
(
5
)
a list of the wildlife development projects carried out and the amount invested for that purpose; and
(
6
)
the number of employees.
The holder of an outfitter’s licence who is a lessee of exclusive fishing rights in a salmon river must also indicate the number of salmon taken, and the weight, length and tag number of each salmon.
