103.1. This subdivision applies to Members who have contributed to the plan established under subdivision 5 and have not applied for a refund of their contributions.
This subdivision does not apply to former Members contemplated in section 41 of the Act respecting the conditions of employment and the pension plan of the Members of the National Assembly (chapter C-52.1).

103.1. This subdivision applies only to Members who are Members of the National Assembly on 1 January 1983 and to Members who become Members subsequently if, at the time of their election, they are receiving a pension under this Act.
