1495. The indemnity is due only if the enrichment continues to exist on the day of the demand.
Both the enrichment and the impoverishment are assessed on the day of the demand; however, where the circumstances indicate the bad faith of the person enriched, the enrichment may be assessed as at the time he benefited therefrom.
