769. If the applicant does not communicate, within the time fixed by the court, the detailed affidavits and required exhibits, the respondent may, at the expiry of the time fixed, obtain that the application be dismissed or that the allegations involved be struck off.

769. If it appears that the boundaries cannot be determined without affecting immoveables which are not contiguous to that of plaintiff, the court may of its own motion or on application order the impleading of the owners of such immoveables.
