638. Subject to the Code of Penal Procedure (chapter C-25.1), the court may use its discretion in awarding or withholding costs, or in ordering the plaintiff or the defendant to pay his own costs or those of the opposite party, and, in certain cases, to pay damages, not exceeding $25, when such damages appear to have resulted by reason of the matters in the case.

638.
