396. The judge having jurisdiction to take cognizance of an application under sections 393, 394 and 395 shall be, in the case of a candidate other than a party leader, the judge to whom an application for a recount must be presented and, in the case of a party leader, the chief justice of Québec.
No such application may be heard without notice of at least three clear days to the director general of elections and to each of the other candidates for election in the electoral district or, in the case of a party leader, to each of the other recognized party leaders.
