39. If the writ is destroyed or lost before the returning-officer has received it, or if he dies before receiving it, or refuses or neglects to act as returning-officer, or resigns or is dismissed, or if for any other reason it is impossible to hold the election on the day mentioned in the writ, a new writ may be issued and the day of nomination and that of the polling may be changed, as circumstances require.
