104. To hear an application, the Tribunal shall sit in a division composed of 3 members, that is, the judge presiding the division and 2 assessors assisting him, designated by the president. The member presiding the division shall decide the application alone.
However, a preliminary or incidental application or an application under section 81 or 82 shall be heard and decided by the president or by the judge to whom he refers the application; such an application shall be referred to a division of the Tribunal in the cases determined by the tribunal regulations.
