“Spouse” means the man or woman who, on the date of the victim’s death, is married to and living with the victim or who has been living in a de facto union with the victim and has been publicly represented as his spouse for at least three years or, in the following cases, for at least one year: — a child has been born or is to be born of their union;
— they have adopted a child together; or
— one of them has adopted a child of the other;
“Dependant” means(1) the person who is separated from the victim de facto or legally, or whose marriage to the victim has been dissolved by a final judgment of divorce or declared null by a declaration of nullity of marriage and who, on the date of the victim’s death, is entitled to receive support from the victim by virtue of a judgment or agreement;
(2) a minor child of the victim and a minor to whom the victim stands in loco parentis;
(3) a child of full age of the victim and a person of full age to whom the victim stands in loco parentis, provided more than 50% of their basic needs and maintenance costs are borne by the victim;
(4) any other person related to the victim by blood or adoption and any other person standing in loco parentis to him, provided more than 50% of their basic needs and maintenance costs are borne by the victim.
