Act respecting the Office de la prévention de l’alcoolisme et des autres toxicomanies

1. In this act, the following expressions mean:
(a)  alcoholism : a pathological condition related to consumption of alcohol and disturbing the physical and psychical balance and the social behaviour of persons suffering therefrom;
(b)  toxicomania : a pathological condition other than alcoholism, related to the consumption of a toxic substance and disturbing the physical and psychical balance and the social behaviour of persons suffering therefrom;
(c)  Office : the Office de la prévention de l’alcoolisme et des autres toxicomanies established by section 2.

2. A body, hereinafter called the Office, is established in the Ministère des affaires sociales under the name of “Office de la prévention de l’alcoolisme et des autres toxicomanies”. Such body may also be referred to by the sigla “O.P.T.A.T.”

3. The functions and powers of the Office shall be:
(a)  to promote research on toxicomania and alcoholism;
(b)  to provide information on the means of preventing and treating toxicomania and alcoholism and on the means of rehabilitating drug-addicts and alcoholics;
(c)  to assist other bodies established to combat alcoholism and other toxicomanias.

4. The Office shall consist of a general manager and the officers and employees considered necessary.
The general manager shall be appointed by the Gouvernement who shall fix his salary; he shall be dismissed only in accordance with section 66 of the Civil Service Act (chapter F-3).
The officers and employees of the Office shall be appointed and remunerated in accordance with the said Civil Service Act.

5. The general manager shall be responsible for the administration of the Office within the scope of the regulations made by the Gouvernement upon the recommendation of the Office.

6. A body attached to the Office is established under the name of “Conseil de l’O.P.T.A.T.”.
The Conseil shall consist of such number of members as the Gouvernement may determine but shall not exceed fifteen; such members shall be appointed by the Gouvernement.
The function of the Conseil shall be to advise the Office on any matter which the latter submits to it respecting the prevention of toxicomania and alcoholism.
The Gouvernement, by regulation, may determine the term of office and extent of the mandate of the members of the Conseil, and decide any matter necessary to the internal management of the Conseil.

7. The members of the Conseil de l’O.P.T.A.T. shall receive no salary as such; they may be indemnified for their expenses in attending meetings and may receive an attendance allowance fixed by the Gouvernement.

8. The Gouvernement, by regulation, may decide any matter necessary to the internal management of the Office and of its Conseil and prescribe any other measure which it deems expedient for the carrying out of this act.

9. The Office may receive benevolent contributions from individuals or public or private bodies wishing to assist in the attainment of the purposes pursued by the Office.
Such contributions shall not be paid into the consolidated revenue fund but shall constitute a special fund managed by the Office; the contributions paid into it and the revenue which it yields shall be invested or deposited by the Office with the approval of the Minister of Finance; the fund and the revenue derived therefrom shall be used by the Office for the purposes for which the contributions were made.
The Comptroller of Finance must ensure, each year, that such funds are used for the purposes for which the contributions have been made.

10. The Minister shall lay before the Legislature a detailed report of the activities of the Office for each fiscal year; such report shall be filed within six months after the end of each fiscal year or, if the Assemblée is not then in session, not later than the fifteenth day during which it sits after the expiration of such delay.

11. The books and accounts of the Office shall be audited each year by the Auditor-General and also whenever the Gouvernement so orders; his reports shall accompany the annual report of the Office.

12. The Minister of Social Affairs shall have charge of the carrying out of this act.
